Terms and Conditions of Sale

1. Purpose
These General Terms and Conditions of Sale (the "Terms") govern the sale and use of the TRACER APP subscription service (the "Service") provided by AYV STUDIO HOLDING ("we", "us"). By subscribing to the Service, the customer accepts these Terms in full.
These Terms are made available to the customer before any payment is confirmed.
2. The Service
TRACER APP is a software-as-a-service (SaaS) application for restaurant operations, cost and profit tracking. It is provided on a subscription basis.
3. Prices and Payment
Prices are displayed in Tunisian Dinar (TND), with any applicable taxes indicated at the point of sale.
Accepted payment methods are: international bank card (Visa / Mastercard), bank transfer (virement), and online card payment through the Flouci gateway (including D17 / e-Dinar).
4. Delivery of the Service
The Service is a digital service. There is no physical delivery. Access to TRACER APP is provisioned electronically and activated as soon as payment is confirmed — in principle immediately, and at the latest within the timeframe indicated at subscription. Access credentials are delivered to the email address provided by the customer.
5. Cancellation
The customer may cancel their subscription at any time. Following cancellation, access to the Service remains available until the end of the current paid period. No refund is granted for the current period.
6. Right of Withdrawal
The customer expressly requests that access to the Service begin immediately upon confirmation of payment. As TRACER APP is digital content supplied immediately by electronic means, the customer acknowledges and agrees that any right of withdrawal (droit de rétractation) does not apply once access has been provided.
7. Returns, Exchanges and Refunds
As TRACER APP is a digital service supplied electronically, it is not subject to physical return or exchange. Except as required by applicable law, payments made for the current subscription period are non-refundable.
8. Dispute Resolution
In the event of a dispute, the parties will first seek an amicable settlement. Failing an amicable resolution, the dispute will be submitted to the competent courts of Ariana / Tunis, Tunisia.
9. Governing Law
These Terms are governed by Tunisian law.
